    2. FHF Gear, part of the MeatEater Inc. family of companies, is based in Bozeman, Montana (referred to in this Privacy Policy (the “Privacy Policy”) as "FHF", "we," "us," "our" or words of similar import). FHF Gear paired the functionality of the hunting and fishing industry with the utility and durability of tactical gear to produce unique and high quality outdoor gear. Using a design that is minimalistic and modular in nature, our products provide the user the freedom to add or eliminate accessories as needed, creating a fully customizable kit for your needs.

    3. Your privacy is important to us and the family of companies. This Privacy Policy describes, among other things, what "Personal Information" we collect about you, how we collect your Personal Information, how we use your Personal Information, including who we disclose it to and why, the measures we take to protect your Personal Information and the choices you may have regarding our use of your Personal Information. The term "Personal Information" is defined below in the section entitled "Personal Information We Collect".

    This Privacy Policy covers all of our services where this Privacy Policy is posted or referenced, including our websites, which are currently located at www.fhfgear.com (the “Site”), our newsletter, our catalog, and our customer support services (collectively, and including the features provided by our Site, the “Services”).

  5. PERSONAL INFORMATION WE COLLECT

    As used in this Privacy Policy, “Personal Information” means information that, on its own or in combination with other information, can be used with reasonable effort to identify an individual, including information such as your name, e-mail address, physical address, phone number, and credit card information.

    You do not need to provide us with any Personal Information about you to simply browse the Site. However, if you want to interact with a Site, open an account with us, register for our newsletter, request our catalog or use any of our other Services, you will need to provide Personal Information about you to us.

    The Personal Information we collect about you can be broadly categorized as follows: (a) information we collect directly from you, (b) information we collect from third party sources, and (c) information we collect automatically by using data collection technologies.

      • • Commercial Information: We collect purchase and transaction historical information about your transactions with us, including details about products associated with the Services you receive from us, and other purchasing tendencies.
      • • Communications: We collect the content of emails, text messages, and other communications, call logs, and calendar information. If you send us emails, you should be aware that any information you provide us via email may not be secure or encrypted and could be accessible by others. Please exercise caution when you provide us any personal or confidential information to us using email.
      • • Research or Performance Surveys: You may provide us Personal Information if you choose to respond to any of our survey requests.
       
    2. Personal Information We May Obtain From Third Parties

      3. We may obtain Personal Information about you from third parties, including publicly available sources. Such sources may include:

      • • Our Family of Companies. We may disclose and obtain Personal Information about you within our family of companies to use in ways that are consistent with this Privacy Policy.
      • • Marketing Databases. We may obtain Personal Information about you from marketing databases and other data enrichment companies to improve our advertising and marketing efforts.
      • • Third Party Retailers. Third party retailers, such as Amazon, eBay and Shopify, may provide us Personal Information about you when you order our goods through their e-commerce websites. We do not have access to or control over the personal or payment information collected by these third-party retailers during transactions, except to the extent your information is shared with us. We recommend reviewing the privacy policies of these third-party retailers:
      • • Publicly Available Information. We may use publicly available information about you that we obtain from websites, search engines and other public sources. We use this information to provide our Services.
      • • Other Sources. We may obtain Personal Information about you from other third-party sources. These could include government entities, advertising networks, data brokers, operating systems and platforms, mailing list providers, social networks and advertising and marketing partners.
       
    3. Information We Collect Automatically

      4. When you use the Services, we (or our third party partners) may automatically collect information about your device and usage of the Services. In some jurisdictions, this information may be considered Personal Information under applicable data protection laws.

      We may use cookies and similar tracking technologies (collectively “Tracking Technologies” or “Cookies”) to collect some of this information. Our use of Tracking Technologies is discussed in more detail in Section 9 below entitled "Cookies and Other Tracking Technologies".

      Examples of the type of information we automatically collect using Tracking Technologies include:

      • • Device and Online Identifiers: We collect device and other online identifiers, such as account login information, MAC address, IP address, cookie IDs, and social media information.
      • • Internet and Other Network Activity Information: We collect information about your browsing activity as well as your interactions with the Site, emails, and advertisements. This information includes the date and time you visit pages on the Site, the items you view, how many times you view a page or item as well as information concerning any emails or other communications that you open, forward or click-through to the Site. If you use multiple devices to access the Site, we may associate your usage from all of your devices together.
      • • Geolocation: We collect data about the location of your device, which may be imprecise (i.e., inferred from your device's IP address). Depending on the device you use to access our Services, (e.g. Apple™, iOS, Google™, Android, Windows, etc.) you may be able to control whether location data is collected from the settings on your wireless device.

    7. We collect and use Personal Information about you to operate and improve the Site, deliver the Services and carry out the transactions you have requested. These uses may include providing you with more effective customer service; making the Site easier to use by eliminating the need for you to repeatedly enter the same information; performing research and analysis aimed at improving our products, services and technologies; and displaying content and advertising that are customized to your interests and preferences.

    We also use Personal Information about you to communicate with you. We may send certain mandatory service communications, such as welcome letters, newsletters, the availability of our catalog, information on technical service issues, and security announcements. We may also contact you to inform you about changes to the Site or changes to any products or services we offer through the Site.

    We may also use Personal Information about you to protect or conduct our business and pursue our legitimate business interests, which include to enforce our terms of use and other agreements; to improve the security of our systems and the exercise or defense of legal claims; to comply with privacy laws and other regulations, such as to manage consent requirements; and to comply with our other legal obligations.

    8. We may disclose aggregated, anonymized information about you and our other users, as well as information that does not identify any individual, without restriction.

    We do not sell Personal Information about you in the sense of receiving cash for the information. However the definition of the term "sale" in some states is broad enough to include transactions that would constitute a "sale" under state law. For example, if you are a resident of Colorado or Connecticut, our use of cookies and tracking technologies constitutes a "sale" of personal information to third-party advertisers. In addition, California law may find that a "sale" has occurred if legal consideration other than money is exchanged.     In certain circumstances we share certain Personal Information for a business or other lawful purpose. The following describes some of the more common circumstances where we share your Personal Information:

    • • Internally. We share Personal Information about you within our family of companies to optimize communications and promotions. This involves sharing information about browsing and purchasing behavior on the Site and targeting promotions and communications accordingly.
    • • Other Companies. We may disclose Personal Information about you to vendors to perform services on our behalf, to service our customers, or perform any contract we enter with you. These vendors include e-commerce platforms, shipping vendors, billing and refund vendors, payment card processors and companies that help us improve our products and services.
    • • Legal And Security Purposes. We share your Personal Information with regulators, law enforcement agencies, public authorities and other governmental authorities to comply with law and legal process, to respond to governmental inquiries and lawful requests by public authorities (including to meet national security or law enforcement requirements), and to protect life, property, or the security of FHF or our customers
    • • Enforce Our Rights. We may disclose Personal Information about you to enforce our agreements with you, including for billing and collection purposes.
    • • Analytics and Research. We share Personal Information derived from Site usage with analytics and search engine providers that assist us in the improvement of the Site, including Google Analytics and Microsoft Clarity. We also use Personal Information for research and development of our goods and Services. Please refer to our "Cookies and Other Tracking Technologies" section below and Cookies Notice for more information on our analytics providers.
    • • Professional or Technical Support. We may share Personal Information with our affiliates, co-development partners, resellers, suppliers, and distributors, and with vendors acting or performing services on our behalf, to service our customers, and perform any contract we enter with you. If we share your Personal Information with affiliates, co-development partners, or with vendors acting on our behalf, we do so under binding agreements that require the third party to use and protect the Personal Information in accordance with the principles described in this Privacy Policy. These third parties are authorized to use your Personal Information only as necessary to provide services to us.
    • • Social Media Companies. We may contract with social media companies to display ads on their service, such as Facebook and Instagram. These companies may use Cookies and similar Tracking Technologies such as pixels to track your activity. The information collected by these social media companies in this manner is subject to their own privacy policies. Please refer to our "Cookies and Other Tracking Technologies" section below and Cookies Notice for more information on our analytic providers used for advertising and marketing.
    • • Sale of FHF. Your Personal Information may be disclosed to and ultimately transferred to a buyer or other successor of FHF if FHF or its business were to be sold, such as by way of a merger, stock purchase, asset sale, or other transaction resulting in the transfer of FHF's business to new owners. Any potential buyer conducting the due diligence associated with a transaction of this type would be required to execute a confidentiality or similar agreement requiring the buyer not to disclose or otherwise use the Personal Information we have collected about you in violation of that agreement.
    • • Bankruptcy. If any bankruptcy or reorganization proceeding were to be brought by or against us, such information may be considered an asset of ours and may be sold or transferred to third parties. Should such a sale or transfer occur, we would use reasonable efforts to require that the transferee use Personal Information provided through our Services in a manner that is consistent with this Privacy Policy.
     
  8. HOW WE PROTECT YOUR PERSONAL INFORMATION

    9. The security of your Personal Information is important to us. We protect your Personal Information through technical and administrative measures designed to mitigate the risk of unlawful or unauthorized access, destruction, loss, alteration, disclosure or use of Personal Information about you. We store Personal Information in data servers that are maintained at one or more commercial data centers owned or operated by companies that are regularly engaged in the business of storing personal data in secure settings pursuant to industry standards governing data security and privacy.

    The safety and security of your Personal Information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

    Unfortunately, the transmission of information via the Internet is not completely secure. We cannot guarantee the security of any information you transmit to either of the Site. Any transmission of information, including Personal Information, is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

      Cookies can be "Persistent" or "Session" Cookies. Persistent Cookies remain on your personal computer or other device when you go offline, while Session Cookies are deleted as soon as you close your web browser. We use both Session and Persistent Cookies for the purposes described below:

      • • Strictly Necessary Cookies. Strictly Necessary Cookies are a Session Cookie. These Cookies enable basic functions on the Site, like page navigation and access to secure areas of the Site. The Site cannot function properly without these Cookies. As such, Strictly Necessary Cookies will always be collected regardless of your Cookie settings. Examples of how we use Strictly Necessary Cookies follow:

    2. Performance Cookies We Use

      We use Google Analytics, a web analytics service provided by Google, Inc. Google Analytics uses cookies to help us analyze how users interact with our Site, compile reports on their activity, and provide other services related to their activity and usage. The technologies used by Google may collect information such as your IP address, time of visit, whether you are a returning visitor, and any referring website. The information generated by Google Analytics is transmitted to and stored by Google and is subject to Google's privacy policies.       Google reCAPTCHA

      We use Google reCAPTCHA, a free service provided by Google, Inc., to protect our Site from spam and abuse. Google reCAPTCHA uses advanced risk analysis techniques to decipher humans and bots. Google reCAPTCHA works differently depending on what version is deployed. For example, you may be asked to check a box indicating that you are not a robot or Google reCAPTCHA may detect abusive traffic without user interaction. Google reCAPTCHA works by transmitting certain types of information to Google, such as the referrer URL, IP address, visitor behavior, operating system information, browser and length of the visit, cookies, and mouse movements.       Microsoft Clarity

      We partner with Microsoft Clarity to capture how you use and interact with our Site. Microsoft Clarity is an analytics tool provided by Microsoft that helps us understand how users interact with our Site. It uses visual tools like heatmaps and session recordings to help improve user experience. It captures anonymous user data, transforms the data into visual insights, and shows what users are doing, where they are clicking, and how they are interacting with our Site content. This information is used to improve and market our products and services. We also use this information for Site optimization, fraud and security purposes, and advertising. The information generated by Microsoft Clarity is transmitted to and stored by Microsoft and is subject to Microsoft's privacy policies.     3. Third-Party Use Of Cookies And Other Tracking Technologies

      4. Some content or applications on our Site, including advertisements, may be served by advertisers, ad networks and servers, content providers, application providers and other third parties. These third parties may use Cookies to collect and store information about you when you use or interact with one of our Site, marketing communications, advertising content and third party websites.

      The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. They may also use Tracking Technologies to measure the effectiveness of advertisements, to personalize advertising content, and to push advertisements to you that are relevant to your regional location. We may also use information collected using third party cookies and beacons on the Services and in our emails to deliver advertising about our Services when you visit third party websites.     4. How You Can Opt Out of Cookies

      The Sites recognize the Global Privacy Control (“GPC”) signal, which is a browser-based opt-out preference signal that communicates your privacy preferences to the websites you visit.     11. Subject to our legal requirements and legitimate business needs, we strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information:

If you do not wish to continue receiving certain marketing materials (e.g., email messages), you can opt-out of receiving these materials by following the unsubscribe instructions provided in the materials. For text messages, reply to any text message with the word “STOP”, or follow the instructions provided in text messages from FHF. Please note that these options do not apply to communications primarily for the purpose of administering orders, contracts, support, product safety warnings, software updates, or other administrative and transactional notices.
    • • Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of our Site may then be inaccessible or not function properly. To manage your Cookie settings, please refer to our Cookie banner on our Site or click on the “Do Not Sell or Share” link at the lower right-hand corner in the footer on our Site.
    • • Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your Personal Information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by checking the relevant box located on the form on which we collect your data.     • • Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt-out through the Cookie banner on our Site or clicking the “Do Not Sell or Share” link at the lower right-hand corner in the footer on our Site.

    We may work with third parties, such as Google Ad Manager, that collect and use information about your website over time and across our Site and non-affiliated websites, including on different devices and browsers. These third parties may use cookies, web beacons, pixels, and other similar technology to collect this information, and use it to infer your interests and deliver relevant advertising to your browser or device, and browsers or devices associated with it. This activity is called interest-based advertising. We do not control such third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way, such as https://adssettings.google.com. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website as well as members of the Digital Advertising Alliance here.

    When you exercise choices through these tools, you will still receive advertising but that advertising may be less relevant to you. After you make your choices, data will no longer be collected from your browser or device for interest-based advertising on that browser or device, or associated browsers or devices. Additionally, data from those associated browsers and devices will not be used for interest-based advertising on the browser or device for which you made your choices. Data may still be collected for other purposes, such as analytics, reporting, and research. If you delete your cookies, or use multiple browsers or devices, you will need to register your opt-out choices again.

    Some devices and browsers support a “Do Not Track” (or, DNT) feature, a privacy preference that you can set in certain web browsers, which is intended to be a signal to websites and services that you do not wish to be tracked across different websites or online services you visit. Please note that we cannot control how third party websites or online services you visit through our website respond to Do Not Track signals.   11. OUR RETENTION OF PERSONAL INFORMATION

We keep Personal Information about you for as long as is necessary to provide the Services to you or to meet the business purpose and need for which it was collected as described in this Privacy Policy or explained at the time we collected the information. This includes maintaining and improving the performance of our Services, keeping our Services secure, and maintaining appropriate business and financial records. Most of our retention periods are determined on the basis of this general rule.
